Terms and Conditions of Service

Effective Date: January 2026

1. Introduction

These Terms and Conditions ("Agreement") govern the provision of drilling and water solution services by Mwanza Drilling Services Co. Ltd (hereinafter referred to as "The Contractor"), a company fully registered in Tanzania, with its principal office located at Rock City Mall, 2nd Floor, Wing A, Mwanza. By engaging our services, the Client agrees to be bound by these terms.

2. Scope of Services

The Contractor agrees to provide services as requested by the Client and detailed in the specific project quotation. These services include, but are not limited to:

• Hydrogeological Surveys.
• Water Well Drilling (Domestic, Commercial, and Industrial).
• Water Pump Installation and Testing.
• Water Quality Testing.
• Water Tank Installation.
• Borehole Cleaning, Flushing, and Maintenance.

3. Hydrogeological Surveys and Feasibility

Prior to drilling, the Contractor may conduct a hydrogeological investigation to analyze soil composition and aquifer levels. While these surveys are designed to increase drilling accuracy and reduce risk, the Client acknowledges that hydrogeology involves natural variables. The Contractor utilizes advanced techniques to locate groundwater but cannot guarantee 100% water availability or specific yield volumes due to unpredictable geological formations.

4. Site Access and Preparation

The Client must provide clear access to the site for the Contractor’s drilling rigs, trucks, and equipment. The Client is responsible for removing any physical obstructions (fences, overhead wires, debris) that may hinder the safe operation of modern drilling machinery.

5. Health, Safety, and Environment (HSE)

The Contractor is committed to strict Health, Safety, and Environment standards:

• Operations will be conducted in compliance with OSHA (Occupational Safety and Health Authority) regulations.
• The Contractor reserves the right to suspend work if site conditions are deemed unsafe.
• Environmentally friendly drilling techniques will be used to protect underground water tables.

6. Quality Assurance and Handover

Upon completion of drilling and installation, the Contractor shall perform pump testing and water quality analysis. Upon commissioning, the Contractor shall provide the Client with a "Water Well & Borehole Passport". This document serves as the official technical record, containing details such as coordinates, drilling depth, casing specifications, and pump capacity.

7. Payment Terms

Payment schedules (deposits and milestones) shall be defined in the specific Project Quotation/Invoice provided to the Client. Failure to make payments as agreed may result in the suspension of services or the withholding of the Water Well & Borehole Passport.

8. Warranty and Maintenance

The Contractor warrants that all workmanship reflects professional standards. Equipment (pumps, tanks) is subject to the specific manufacturer’s warranty. Post-installation maintenance services are available upon request to diagnose issues and prolong system lifespan.

9. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Tanzania.
